GOODWYN, Justice.

The appellant in the Court of Appeals has petitioned us for a writ for certiorari to review the opinion and decision of that court in the case of Anderson v. State of Alabama, 120 So.2d 397.

Petitioner avers in his petition “that he has filed his application for rehearing in said Court of Appeals, within the time required by law, and that said application for rehearing in the Court of Appeals was overruled on the first day of December, 1959.” The State has filed a motion to strike the petition on the ground that it fails to comply with Rule 39 of the Revised Rules of the…
