This action was begun before a justice of the peace, on an account for lumber. On appeal to the circuit court judgment was rendered for the plaintiffs.
The record shows that while the judgment was rendered at the September term of court, the motion for new trial was filed at the following January term. The motion was therefore out of time and cannot be considered. The record also shows that the bill of exceptions was not filed until the following April term, and no order granting an extension of time.
