This cause is here on the appeal of plaintiff from a judgment entered for defendant in the circuit court on the 18th day of August, 1903. The hearing in this court was set to occur on Monday, October 1, 1906. Three days before that date, appellant filed his abstract of record and brief, service of which had been acknowledged by respondent on September 10th, twenty days before the hearing. On September 20th, appellant acknowledged service of a motion to dismiss the appeal and a brief in support thereof, which respondent filed on September 26th.
