This matter comes before the court on defendant’s and intervenor-defendant’s motions for summary judgment pursuant to Federal Rule of Civil Procedure 56 (DE ## 84, 86).1 Plaintiffs timely responded in opposition, and defendant and intervenordefendant replied. For the following reasons, defendant’s and intervenor-defendant’s motions are granted.
