This is an action against the sureties on the official bond of Mr. M. M. Fulkerson, given by him as treasurer of school district No. 1 of Woods county, Okla. The cause was tried to a jury, resulting in a judgment for the defendants, from which the plaintiff has appealed to this court.

The evidence in the case shows that Ful-kerson was elected treasurer on the 7th day of April, 1908, and executed the bond herein sued on the 28th day of said month to the -board of education of the city of Alva.
