Plaintiffs, registered motor vehicle owners in the Commonwealth of Puerto Rico, filed this peculiar action pursuant to 42 U.S.C. § 1983. They allege that the Commonwealth’s Governor and Secretary of the Treasury (“the Secretary”) 1 violated the United States Constitution’s Takings and Procedural Due Process Clauses by accepting the transfer of certain insurance premiums generated by the Commonwealth’s compulsory motor vehicle insurance law.
