Plaintiffs, registered motor vehicle owners in the Commonwealth of Puerto Rico (“Plaintiffs”), bring this action pursuant to 42 U.S.C. Section 1983. They allege that the Governor of Puerto Rico and Secretary of Treasury of Puerto Rico (“the Secretary”) (collectively, “Defendants”) violated the Due Process Clause of the Fourteenth Amendment and the Takings Clause of the Fifth Amendment by accepting the transfer of certain insurance premiums generated by the Commonwealth’s compulsory motor vehicle insurance law.
