Petitioner Jomo Delesline (“Delesline”), currently incarcerated at Attica Correctional Facility in New York (“Attica”), brings this amended petition (the “Petition”) for a writ of habeas corpus pursuant to 28 U.S.C. § 2254 (“§ 2254”) against James T. Conway, the superintendent of Attica (“Respondent”). Delesline was convicted in New York State Supreme Court, Bronx County (the “Trial Court”), of three counts of attempted murder in the second degree, in violation of New York Penal Law (“NYPL”) § 110/125.25(1).
