1Opinion of the Court

ON WRIT OF CERTIORARI

CARLSON, Presiding Justice,

for the Court:

¶ 1. Johnny Brown was convicted of murder and sentenced as a habitual offender to life imprisonment in the custody of the Mississippi Department of Corrections. From the Hinds County Circuit Court judgment of conviction and sentence, Brown appealed, and we assigned the case to the Court of Appeals. After the Court of Appeals affirmed the trial-court judgment, we granted Brown’s petition for writ of certiorari. Finding error in the trial court’s refusal to give an accidental-shooting instruction, we reverse and remand.
