This is a putative class action brought under the Employee Retirement Income Security Act of 1974 (“ERISA”), 29 U.S.C. § 1001 et seq., in which Plaintiff seeks damages and equitable relief for Defendants’ breach of fiduciary duty (a) in using Coca-Cola stock in Coca-Cola’s Thrift and Investment Plan, and (b) in providing incomplete and misleading information regarding certain business affairs of the Coca-Cola Company to participants in the Thrift and Investment Plan.
