*477MEMORANDUM OPINION AND ORDER

SHADUR, District Judge.

Ernest Coleman (“Coleman”) brings this action under Title VII of the Civil Rights Act of 1964 (42 U.S.C. §§ 2000e to 2000e-17) and under 42 U.S.C. § 1981,1 charging both Greyhound Lines, Inc. (“Greyhound”) and Amalgamated Transit Union, Local 1150 (“Union”) with race discrimination2 in Greyhound’s termination of Coleman’s employment and Union’s failure adequately to process his resulting grievances. Coleman’s Complaint was filed May 4, 19833 and Greyhound was served May 27, but Union was not served until October 31. Union now moves to dismiss…
