This case comes before us on a writ of review directed to the Court of Appeal for the parish of Orleans. The case was dismissed in the civil district court on exceptions of no cause of action, and the judgment dismissing it was affirmed on appeal.

It appears from plaintiff’s petition (the allegations of fact in which must be taken as true for the purposes of the exceptions of no cause of action) that the New Orleans & North Eastern Railroad Company on February 15, 1922, drew a draft through its agent, O.
