Plaintiff, to obtain a provisional remedy prior to the commencement of an action in replevin, has presented to the court a proposed order directing a marshal to seize, without prior notice, certain described property in the possession of defendants, and to enter into any premises for that purpose.

In support of the proposed order the plaintiff has submitted a complaint and affidavit, from which it appears that the defendant and his wife purchased, on an installment basis, a 5-piece bedroom set, mattress and spring, and a TV set from the plaintiff under two separate contracts dated respectively…
