This was an action by the appellee, as plaintiff, against the appellant, as defendant, commenced before a justice of the peace of White county, to recover the possession of a certain quantity of corn, of the alleged value of thirty dollars.
The trial of the cause before the justice resulted in a verdict and judgment for the appellee, from which the cause was appealed to the court below.
In this latter court the cause was tried by a jury, and a verdict was returned for the appellee; and the appellant’s motion for a new trial having been overruled by the court, and his exception saved to such…
