Petitioners, High Rock Lake Partners, LLC (High Rock) and John Dolven, appeal from the superior court’s judgment affirming the deci sion of the DOT Driveway Permit Appeals Committee (the committee) and denying High Rock’s motion to supplement the record. Respondent, the North Carolina Department of Transportation (DOT), cross-appeals from the interlocutory order entered 8 May 2008 finding “ ‘good cause’ shown for the Petitioner to file an untimely Petition for Judicial Review from the Department’s Final Agency Decision.”
