Plaintiff in error, Ernest J. Stevens, was indicted in the criminal court of Cook county, with his father, James W. Stevens, and his brother, Raymond W. Stevens, charged with embezzlement under section 75 of the Criminal Code. (Smith’s Stat. 1933, p. 1030.)
