Plaintiffs Caleb & Co. and Unit & Co. (collectively, “Caleb”) have moved pursuant to Rule 23(c)(1), Fed.R.Civ.P., for an order certifying a class of plaintiffs in this action. Caleb asserts in its complaint that defendants E.I. DuPont de Nemours and Co. (“DuPont”), First Jersey National Bank (“First Jersey”) and Conoco, Inc.
