This is an action brought under the Social Security Act, 42 U.S.C. § 405(g) (“the Act”), to review a final decision of the Commissioner of Social Security (“Commissioner”) denying plaintiffs application for Social Security Disability benefits. Defendant moved for judgment on the pleadings pursuant for Fed. R. Crv. P. 12 (c) affirming the Commissioner’s decision. Thereafter, this motion was referred to the Honorable Sharon E.
