THE BACKGROUND OF THIS ORDER IS AS FOLLOWS:

Plaintiff Reginald McFadden filed the above civil rights complaint pursuant to 42 U.S.C. § 1983. He is currently confined at the Sullivan Correctional Facility in Falls-burg, New York.
