During the year 1902, W. E. Parker contracted with the defendant to cultivate his land — the defendant furnishing and feeding the team, farming implements, etc., and Parker furnishing and feeding the labor to cultivate and save the crop. The fertilizers were to be paid for by both parties in equal proportions. The crop, except the corn, was to be divided equally; of the corn Parker was to have only one-fourth. Parker cultivated the crop until the latter part of July when he was taken sick, and died on September 6th. A few days before his death the plaintiff, being enciente, left the…
