MEMORANDUM AND ORDER

SCHILLER, District Judge.

This action arises from injuries suffered by Plaintiff Edward Mack, who fell on an icy sidewalk after a tow truck operator refused to transport him. Mack asserts claims of race discrimination under 42 U.S.C. § 1981 and negligence against Defendants AAA Mid-Atlantic, Inc. (“AAA”) and Kelly’s Texaco & Towing (“Kelly’s”). Presently before the Court are motions for summary judgment filed by: (1) AAA; (2) Kelly’s and Third Party Defendant Michael Kelly; and (3) Third Party Defendants Wincenzo and Alba Bianchimano, doing business as Cantinho Brasileiro…
