I. INTRODUCTION
The plaintiff, Maureen Ward (“Ward”), was seriously injured on October 21, 2001 when a car shé was driving was hit by a vehicle driven by Malcolm Hicks (“Hicks”), who was speeding the wrong way down I-93. At the time, Hicks was fleeing from Boston Police Officers, Emmanuel Dam-breville and Lamont Anderson.
