Marcos Martinez, as administrator of the estate of Jeffrey Martinez, filed this action against Boston Police Officers William Hubbard, Bernard Hicks, Robert Col-burn, Donald Caisey, and Scott Roby, for assault and battery and constitutional'violations within the scope of 42 U.S.C. § 1983 and the Massachusetts Civil Rights Act.
