KING, Chief Judge:

This court’s opinion, 323 F.3d 325 (5th Cir.2003) is hereby withdrawn, and the following opinion is substituted:

Petitioner Manuel Navarro-Miranda seeks review of two decisions by the Board of Immigration Appeals concerning his deportation following a felony conviction for driving while intoxicated. We deny Navarro-Miranda’s petition for review of his motion to reopen his removal proceedings. As for Navarro-Miranda’s petition for review of the denial of his motion to reconsider, we dismiss it as untimely filed.
