OWENS, Chief Judge:
The plaintiff in this action is a former employee of the defendant railroad. According to the facts established by the pleadings and stipulated thereto by both parties, the plaintiff was discharged from the defendant’s employ on May 16, 1978, after having been found guilty of “disloyalty,” a proper ground for discharge under the applicable collective bargaining agree ment. The plaintiff appealed this decision to the Public Law Board, No. 1261, pursuant to the Railway Labor Act, 45 U.S.C. § 153.
