During August and October of 1995, appellant was tried by a general court-martial composed of officer and enlisted members at Fort Campbell, Kentucky. Contrary to his pleas, he was found guilty of several offenses related to the death of 16-month-old Niko Martinez, ie., accessory after the fact to assault, involuntary manslaughter, child neglect, and misprision of a serious offense, in violation of Articles 79,119, and 134, Uniform Code of Military Justice, 10 USC §§ 879, 919, and 934, respectively.
