On January 25, 2005, Jerry Wilson Har-relson, Sr. (“Jerry”), filed a petition in the Tallapoosa Probate Court (“the probate court”) seeking to probate the will of his father, Horace Wilson Harrelson (“Horace”). On that same date, the probate court entered orders admitting the will to probate and granting letters testamentary allowing Jerry to serve as executor of Horace’s estate.
