This action was instituted by the appellee to recover on an oral contract of insurance alleged to have been effected between Ida Thiel, wife of the appellee, and the appellant in which, contract of insurance the appellee was named bene ficiary. The original complaint was in six paragraphs. Subsequently all were dismissed except the third and the sixth, to each of which, answers, in general denial were addressed.

The case was submitted to a jury for trial which returned a verdict for the appellee in the sum of $2488.71. The court rendered judgment on this verdict, a motion for new trial was…
