Camínele, J:

This was a bill filed for tlie specific performance of a contract whereby Harry Miller, now deceased, on the first day of August, 1867, agreed to sell to Kobert McQueen block seventeen in Miller’s addition to tbe city of Saginaw, containing eight city lots, for one thousand nine hundred dollars, payable with interest in four yearly instalments, with a condition requiring improvements to the amount of one thousand dollars to be made within a year.
