MEMORANDUM OPINION
WALTON, District Judge.
In this matter, plaintiff, St. Luke’s Hospital (“St.Luke’s”), seeks judicial review of the denial by the defendant, the Secretary of Health and Human Services (“Secretary”), of its application for reimbursement of funds under the Medicare program as a result of plaintiffs request for an exception to its prospectively determined end-stage renal disease (“ESRD”) composite rate for the 1993 fiscal year. 1 42 U.S.C. § 1395rr(b)(7) (2000).
