The petitioner and the respondents, in response to the Court’s order, have supplied the Court with briefs regarding the potential exhaustion of count one of this petition. The Court had called for these additional briefs after it had reviewed the record in this case. After that initial review, it appeared to the Court that count one, regarding the impropriety of the M’Naughten rule, had never been placed before the state courts as a matter of procedural or substantive due process.
