This is an action brought on behalf of the state to recover on the interest coupons of municipal bonds issued by the county of Wichita, and it is the second time that the controversy has been before us for consideration. (The State v. Wichita County, 59 Kan. 512, 53 Pac. 478.) The bonds in issue are known as refunding bonds, authorized by chapter 163 of the Laws of 1891 (Gen. Stat. 1897, ch. 48, §§ 1, 3, 4; Gen.
