This is an appeal regarding a receivership issue in a fraud case. Appellant Victor M. Javitch (“Javitch”) is the second receiver appointed in the underlying litigation. Liberte Capital Group, LLC v. James A Capwill, et al, 229 F.Supp.2d 799 (N.D.Ohio 2002). That case involves allegations that James A.
