Dell, Chief Justice.

This is an action to set aside a deed and have it declared void. Plaintiff appeals from a judgment rendered in favor of the defendant.

The facts in this case are not in dispute and may be summarized from the findings of fact by the trial court. Plaintiff and Grace Van Devere had been married for a period of 33 years. They had no children but Mrs. Yan Devere, by a previous marriage, was the mother of two children, a daughter, Marie Eeiter, and a son, Daniel Parks. Daniel died intestate on July 10,1948, leaving his mother as his sole heir. She was duly appointed…
