Rosalsky, J.:

The defendant was arrested and arraigned before Magistrate House upon an information charging him with a violation of section 1 of an ordinance in relation “ to speed regulations,” which took effect June 1, 1913, in that he did unlawfully operate a motor vehicle at the rate of twenty-three miles per hour on Eighth avenue, between 48th and 47th streets, in the-*164Borough of Manhattan, County of New York. The section referred to reads as follows:
