The defendants were tried before me on December 11, 1916, charged with loitering for the purpose of prostitution in violation of section 1458 of chapter 410 of the Laws of 1882, known as the “ Consolidation Act.” The case now comes before me for final disposition.

The evidence of the complaining witness, a police officer, showed that the defendants, both young women, were first observed by him in One Hundred and Twenty-fifth street, a public thoroughfare in the borough of Manhattan, city and county of New York, on December 8, 19.16, shortly before midnight,…
