This appeal grows out of a suit instituted in tbe court below (C. P. Allegheny County) on August 26, 1944> by tbe Insurance Commissioner of tbe Commonwealth, as statutory liquidator of tbe Keystone Indemnity Exchange, against tbe personal representatives of a deceased subscriber to tbe Exchange for tbe recovery of an assessment alleged to be due by the subscriber in accordance witb a levy made by tbe Commissioner on September 12, 1938, pursuant to an order of that date by tbe Court of Common Pleas of Dauphin County.
