Applicant was charged with the capital murder of his girlfriend’s 17-month-old child, Tristen Rivet. The State’s case largely depended on the expert opinion of Dr. Patricia Moore, the medical examiner who performed the autopsy and who testified that Tristen died from asphyxia due to the compression of her chest and abdomen.
