The information in this case charges that the defendants Bob Hanna, Jim Montgomery, and Bill Edison did, in Ottawa county, on the 13th day of November, 1923, sell to Poly McAffery one pint of intoxicating liquor. The case was dismissed as to the defendants Jim Mont gomery and Bill Edison, and they testified as witnesses for the state.

On the trial of the defendant Bob Hanna, the jury returned a verdict finding him guilty as charged in the information and fixing his punishment at confinement for 90 days in the county jail, and a fine of $3'00. From the judgment rendered on the verdict, he…
