Plaintiff Health Grades, Inc. (Health Grades) asserts claims against Defendant Robert Wood Johnson University Hospital, Inc. (RWJ) for copyright infringement, trademark infringement and breach of contract arising from RWJ’s unauthorized publication of Health Grades ratings and awards for RWJ’s healthcare services. RWJ has moved to dismiss Health Grades’ complaint for failure to state a claim pursuant to Rule 12(b)(6).
