Respondent, as plaintiff, brought this suit against petitioner, as defendant, to recover the proceeds of a policy of insurance on the life of plaintiff’s husband, Archibald Douglass Methven, Jr. Trial was to a jury, but at the close of the evidence both parties filed motions for an instructed verdict. The trial judge discharged the jury and rendered judgment for the plaintiff for the sum of $3,324.54, plus interest, the statutory penalty, and attorney’s fees.
