MR. JUSTICE ADAIR:

This is an appeal from an order denying a motion for change of place of trial.

Action Commenced. On March 5, 1956, the plaintiff, Lorenzo W. Johnson, commenced this action by filing in the district court of the eighth judicial district of the State of Montana, in and for the County of Cascade, a complaint against the defendants at which time summons in the action, directed to each of the defendants, duly issued out of said district court.
