Before the court is the plaintiffs motion filed February 14, 1996, to remand the above-styled action to the Circuit Court of Houston County, Alabama, and to award attorney’s fees and costs against the defendants. Also before the court is the plaintiffs motion filed February 9, 1996, to substitute Terry Thomley for Forrest Thomley as a party defendant in this action.
