The above-entitled case presents the question of when to award fees to attorneys who successfully resist a removal from state court. In Gray v. New York Life Ins. Co., 879 F.Supp. 99 (N.D.Ala.1995), this court explained why this case was remanded to the Circuit Court of Jefferson County, Alabama, on motion of plaintiffs, Marlon Gray, et al., after having been removed to this court by defendants, New York Life Insurance Company, et al.
