I. Introduction

Thoroughbred race-horse owner and licensee of the New York State Racing and Wagering Board (“Racing Board”) Robert Perez (“Perez” or “Plaintiff’) brings this action to challenge a $3,000 fíne imposed on him by the Racing Board following a profanity-laced verbal and physical outburst by Plaintiff at a meeting he requested, and which was held on August 31, 2000. 1 Plaintiff contends that by upholding the fine, imposed pursuant to N.Y.
