OPINION
FARNAN, Chief Judge.
In this action, the Plaintiff, Dorothy Carrigan, an inmate at the Women’s Correctional Institute (“WCI”), alleges claims under 42 U.S.C. § 1983 and state law against the Defendant, Peter Davis, a former correction officer at the prison. Specifically, the Plaintiff alleges that Defendant Davis violated her Fourth, Eighth and Fourteenth Amendment rights and acted with gross and wanton negligence, when he sexually assaulted her while she was incarcerated at WCI.
