MULLIGAN, Circuit Judge:

Vincent Gugliaro appeals from a judgment convicting him of making false declarations while under oath in a federal court. Judgment was entered in the United States District Court for the Southern District of New York on March 1, 1974, after a jury trial before Hon. Inzer B. Wyatt, United, States District Judge. He also appeals from an order of Judge Wyatt of February 28, 1974, denying his motion for a new trial. Gugliaro was indicted on seven counts for making false declarations in violation of 18 U.S.C. § 1623. He was acquitted on six counts and convicted of one count…
