MEMORANDUM

HARMON, District Judge.

Pending before the Court is the Motion for Partial Summary Judgment (Instrument No. 36) submitted by the Defendant State Farm Fire and Casualty Company (“State Farm”). Having considered the motion, the lack of a response, plaintiffs representation to the Court at docket call that the motion is unopposed, and the applicable law, the Court is of the opinion that the motion should be granted.
