HALE, District Judge.
This case comes before the court upon the question of adjudication. Has the respondent committed an act of bankruptcy ? The petition alleges :
“First. That said Addle AT. McLoon did convey, transfer, execute, and make a mortgage to Albert C. McLoon of Dockland, aforesaid, on the 9th day of September, A. D. 1905, as appears on the face of the deed, but which is acknowledged on September 9, 1906. and recorded in the Knox registry of deeds at Rockland on the 31st day of December, A. D. 1906, at 9:30 o’clock in the forenoon, in Book 139, p. 356, the aforesaid date of record…
