HALE, District Judge.

This case comes before the court upon the report of Edwin L. Vail, Esq., one of our referees in bankruptcy. The report is as follows:

“I, Edwin L. Vail, the referee in bankruptcy in charge of this proceeding, do hereby certify that in the course of such proceeding an order, a copy of -which was annexed to the petition hereinafter referred to, was made and entered on the 30th day of August 1905; that Joseph W.
